Most students know that the period of study can be interrupted for good reasons. After the end of the break, young people continue to attend classes with the preservation of budget places. What are the reasons for academic leave?

Under certain circumstances, students may temporarily stop studying to solve problems that have arisen. During this period, you will not have to attend classes and take exams. This type of additional vacation is called academic leave (AO). Its duration depends on the needs of the student. The term of the academy is issued from six months (one sessional period) to 2 years. In exceptional cases, the time off may be extended.

The reasons for taking a leave of absence vary depending on the individual circumstances of the student. Among the grounds for registration of JSC, the most popular are the following:

  1. Leave for medical reasons. Granted to a student in case of prolonged illness, if during this time learning is difficult.
  2. JSC for pregnancy and childbirth. Also, students often take the opportunity to arrange an academy for the need to care for a child.

The application for academic leave in 2018 does not have a standard form. As a rule, special forms are developed by educational institutions. A request is made to the name of the rector, the following information is indicated:

  • surname, name, patronymic of the student, faculty of education, course, department, specialty;
  • reason for leave with supporting documents;
  • duration of the academy.

How long is academic leave?

Academic can be taken for no more than a year for the entire period of study. Leave for military service

Since it is not always possible to get academic leave, it is necessary to study the grounds under which a temporary break is allowed, as well as find out the student's course of action.

Academic leave legislation: what to follow

According to the name, academic leave is granted to a student studying at an educational institution in order to resolve temporary difficulties that prevent him from continuing his studies in the current conditions.

When determining how to issue, using the right to take an academic, they proceed from the provisions of Law No. 273-FZ (“On Education”). The provisions of the legislation give the student the right to receive education and the obligation to fully master the program provided for by a particular specialty. Also, the student is obliged to coordinate his actions with the order in force within the educational institution.

Since students are required to attend classes and take part in the life of the university, there must be valid reasons, documented for skipping. When a student is not attending lectures due to an illness (for example, a cold or a viral infection), a certificate from the medical institution confirming the diagnosis and the inability of the person to attend school during the specified period of time. A similar document is needed if the duration of the illness is prolonged and the student needs long-term treatment.

The law does not distinguish between what is needed in a college and a university. The process of processing documents for the university, confirming the existence of good reasons, is established by a separate Order of the Ministry of Education No. 455. Students undergoing 2-5 years of study will be able to receive exemption from the educational process for 1 year or longer. If the period of study does not exceed 12 months, there is no point in providing an academy.

The right to issue a temporary absence is exercised at any time during the period of study, without forgetting to take into account the possible specifics of the program. For example, having gone to the academy in the middle of the semester, they return to study, starting anew the last academic period (that is, in those subjects that the student did not have time to pass before leaving).

Is it possible to issue without a reason

The right to academic leave is fixed in paragraph 12 of part 1 of Art. 34 of Federal Law No. 273, however, a student of a secondary technical or higher institution will be able to use it if he submits documentary evidence of compelling circumstances.

According to Order 455 of the Ministry of Education, adopted on June 13, 2013, such situations include the following wording when you can take academic leave at the university:

  • according to the conclusion of physicians;
  • due to family circumstances, in which the continuation of studies is temporarily impossible;
  • Military service.

Under these formulations lies the personal situation faced by the student. Having issued the vacation properly, he will be able to continue his studies from the moment of interruption, from those academic disciplines that he studied before going on vacation, or if there are debts. The student has the right to move on to the program of the next semester if the subjects were handed over before leaving and the last session was closed.

It’s not worth it to simply refuse to study for no reason and count on a return to a university. The administration has the right to exclude a student for absenteeism, if, before being absent, the student does not agree with the academy, confirming the validity of the reasons with certificates and documents.

Depending on the justification, the final list of papers attached to the application will differ.

There are some nuances in the procedure:

  1. Vacation according to the indications of doctors. Unsatisfactory state of health due to illness, in which it is impossible to study, exacerbations due to chronic diagnoses, surgical operations, a rehabilitation period due to an injury, deterioration in health with the need for a long recovery.
  2. Family circumstances include the period of pregnancy, the prenatal and postnatal period, caring for a newborn, and up to the child reaching 3 years. A temporary break is allowed if a family member is seriously ill in the student's family, or it is required to arrange care for a child with a disability upon reaching the 3rd year. Family circumstances also include a serious need, which does not allow paying for studies.
  3. For the army. If students are given a deferral for full-time education, then there is no such indulgence for part-time students. The administration will agree on a break for the duration of the service for students in absentia.

In agreement with the administration of the institution, the student indicates other reasons as the basis for the academy. For example, when planning a long-term foreign internship or due to natural disasters or extraordinary circumstances.

It must be understood that any basis indicated in the application needs written confirmation in the form of a certificate, referral, or other document.

Leave for the elimination of educational debts is not provided by law. If an attempt to use the academy to pass "tails" in several disciplines at once is detected, the student is threatened with expulsion.

Registration procedure

You can use the right in a strictly specified time interval. The university management has the right to agree on several deferrals, lasting 2 years each. However, the specific conditions depend on the circumstances.

More often, students need from 6 months to 1 year to solve temporary difficulties, however, when planning the birth of a child, some students take a vacation that reaches a total of 6 years.

We prepare documents

To apply to the administration, an application is prepared, and supporting documents are attached to it.

Applications can be certificates of pregnancy, medical opinions, summons from the military registration and enlistment office, depending on the cases in which leave is required.

It should be noted that the university reserves the right to consider the application within 10 days, after which an order will be issued on the student's academic leave due to the circumstances specified in the application.

How to write an application

Since the application for an academician is the main document upon approval, it is necessary to draw up the paper correctly, having determined in advance:

  • a reason that will prove the validity of the student's arguments;
  • applications that may be required as an argument.

There are some requirements for the structure of the application related to the inclusion of mandatory items:

  3. Reasons for leave. It is issued in the text part of the application. In addition to the reason itself, the duration of the upcoming absence is indicated, i.e. how much does the academy take.
  4. In conclusion, the student puts a signature with a transcript, the date, and also lists the list of documents that prove the presence of a good reason.

It will not work to issue a temporary break in studies without certificates confirming the existence of serious reasons for which training is impossible.

There are some difficulties in applying for an academic leave for each of the reasons indicated in the application. For example, a student often goes on vacation due to pregnancy and upcoming childbirth.

For the approval of the academy for pregnancy, you need:

  • Prepare and submit to the administration a certificate from doctors in the form 095-u and a document confirming the pregnancy.
  • Based on the appeal, a referral to the IEC (medical board) will be issued.
  • At the place of registration or in the clinic to which the university is attached, they pass a commission. For her, you will need to prepare a record book, a student ID card, an extract from a consultation on registering a pregnant woman, a certificate 095-y.
  • After the decision of the doctors is received, it is submitted to the rector's office along with a prepared application.

Since after pregnancy a woman has the right to go on academic leave to care for her child, the break period can be extended.

There are no clear requirements for the procedure for coordinating academic leave for family reasons due to the heterogeneity of the facts that make education impossible. The legislative framework

Academic leave is a period of time during which a student is exempted from studying on the basis of an order from the university in connection with some life circumstances, for example, the birth of a child, documented and with an application.

At the same time, the student from the university is not expelled and his place is retained, as well as the previous conditions for obtaining education, namely at the expense of budgetary funds or on a contract basis.

The right to receive academic leave is regulated by the norms of the Federal Law "On Education", namely clause 12, part 1, article 34, in accordance with which, each student can receive exemption from classes for a certain period, but only on the grounds approved by regulations and Bylaws of the university. In particular, the list of grounds, conditions for granting, as well as the procedure for issuing this type of leave are specified in the Order of the Ministry of Education and Science of the Russian Federation No. 455, but additional conditions related to the peculiarities of obtaining academic leave are already established by the Charter of the educational institution.

To whom and where can this type of leave be provided

In accordance with clause 1 of Order No. 455, academic leave can be provided in educational institutions to students for the following educational programs:

That is, academic leave is provided in all educational institutions that provide secondary, higher education, and also train highly qualified personnel on the basis of Article 10 of the Federal Law No. 273.

Also, as follows from the meaning of clause 1 of Order No. 455, academic leave is granted to all persons who study at the above institutions, regardless of the form of education, that is, students who receive education have the right to this leave in the following forms:

  • full-time;
  • part-time;
  • correspondence.

That is, regardless of whether the student is a part-time student or receives full-time education, in the event of certain circumstances, he has the right to academic leave in the manner prescribed by law.

Reasons and circumstances

In fact, academic leave is a measure aimed at preserving the right and opportunity of a student to continue receiving education after the termination of the reasons that were the basis for exemption from education, but subject to the following conditions:

  • medical indications;
  • family circumstances;
  • exceptional circumstances.

Medical

As a rule, when a disease occurs and a citizen is contacted by a medical institution, a certificate is issued either, on the basis of which he is released from work or employment until complete recovery. In the event of an illness in a citizen who is studying at an educational institution, a certificate of the established Form No. 095y, which gives exemption from classes from 10 to 30 days.

If the student, due to the complexity of the disease, cannot be completely cured within the agreed time, a certificate is issued according to the form No. 027, which, in fact, is an extract for continuing education or a referral to a medical commission for examination, based on the results of which a medical report is issued.

That is, in order to receive academic leave for medical reasons, you need provide three documents:

  • certificate No. 095u;
  • certificate No. 027у;
  • medical opinion.

The agreed documents will confirm not only the grounds for release, that is, an injury or a serious illness, but also the period required to restore health, especially if there is a long rehabilitation period, for example, six months or more.

Family circumstances

Family circumstances and problems are, of course, different, but in order to receive an academic leave, they must also be documented.

Call for military service

Of course, no one is immune from the occurrence of family problems and deterioration in health, but there may also be circumstances that do not depend on the will of the parties and involve a long absence. In particular, a student may be drafted into the army for military service, and the basis for granting academic leave will be a summons indicating the place of conscription and the deadline for appearing to be sent to the place of service.

Procedure and term of provision

According to the norms of the law, namely the Federal Law No. 273, an educational institution, as well as teachers, are responsible for the life and health of students, in turn, the student is obliged to fulfill the curriculum, respectively, any absence of a student in the classroom must be documented in writing in the manner prescribed by law, because to answer for injuries received by a citizen, or lack of knowledge, no one is interested.

That is why the procedure for granting academic leave has been developed at the legislative level, which is enshrined in Order No. 455. In turn, the stipulated act serves as the basis for developing a procedure for granting this type of leave already at the place of use, that is, in each educational institution in the Charter.

The main department in an educational institution, which, in fact, serves as the center of interaction between the parties, is dean's office and it is to this body that you need to apply for an academic leave. Of course, it is advisable to first approach the methodologist or the curator of the group and clarify some conditions for obtaining this type of vacation, as well as a list of documents that need to be provided. I would like to point out one feature. Academic leave provided only for good reasons documented, and not for poor academic performance. And a student who will be absent for a long time due to vacation will continue his education exactly from the place where he graduated, on the basis of a certificate that he will be given indicating the grades received and the hours of lectures.

Drawing up an application

Despite the fact that at the legislative level a unified procedure for issuing an academic leave has been established, the application form for obtaining it has not been approved, therefore, in such a situation, free form subject to mandatory rules. In particular, an indication of the name of the university and the official being addressed, full name, student, group number, course.

In the main part of the application, the student asks for academic leave for family reasons, for example, caring for a sick relative with reference to the application, namely a medical report or other document confirming a good reason for receiving academic leave.

List of documentation

Considering that in the norms of the law, namely in clause 2 of Order No. 455, there is a direct indication of confirmation of the grounds only in writing, the student, when applying for an academic leave, should provide a certain package of documents, which actually confirms the reason for going on vacation.

In particular, in the presence of pregnancy, the student will need to present a certificate from the antenatal clinic about her condition and the timing of the expected birth. If the student drafted into the army, then an agenda will be needed, and if sick or injured then a medical report.

One more feature should be noted. As a rule, in order to apply for an academic leave, a student must appear in person at the dean's office, but he can be seriously injured, as a result of which his movement will be limited. In such a situation, it is allowed to issue an academic leave by proxy, which will be issued in accordance with the norms of the law and presented when applying for a leave.

Order

After the application along with the documents is submitted to the dean's office and a resolution is imposed on the agreed document, within 10 days from the receipt of the application, an order is issued to grant leave, the form of which is approved by the Charter of the educational institution. The order indicates the grounds for granting leave, the period, as well as other conditions, for example, maintaining a place in a hostel or providing monthly payments, provided for by Decree of the Government of the Russian Federation No. 1206 in the presence of a medical certificate.

Some Features

Of course, vacation is not always granted exactly for the period that the student needs, because in some cases, the student himself does not know the cut-off date for the termination of the circumstances that served as the basis for receiving academic leave. In addition, it is worth considering the fact that there is an educational program with its own characteristics and other circumstances that affect the procedure for granting the agreed leave. That is why, at the legislative level, some rules for obtaining vacations are provided, in particular, the timing and number of their receipt.

For how long is it provided

So in clause 2 of Order No. 455 it is said that academic leave can be granted no more than 2 years, due to the fact that, after a specified period, the student will simply forget the knowledge gained without practical training and he will have to start all over again or update his knowledge by retaking some disciplines.

Quantity

In accordance with clause 3 of Order No. 455, academic leave may be granted unlimited number of times, regardless of the reasons that served as the basis for issuing an academic leave.

After all, a student can get sick, get pregnant or lose income for two years, given that life is unpredictable, so there are no restrictions.

Scholarship payment

As a rule, the right to receive, as well as its size and conditions, are determined by the Charter of the educational institution. For example, in many universities, the size of the scholarship depends on the progress of students, as well as on the form of education.

That is, if a student studies on a budget, the state pays him a scholarship, if on a contract basis, then the future employer, who pays for the education.

And since, on the basis of clause 6 of Order No. 455, tuition fees are not charged during the period of academic leave, the scholarship is not paid accordingly. The same rule applies to students studying at the expense of the state, because they do not study, there are no grades on the basis of which to set a performance score, and accordingly there are no grounds for awarding scholarships.

Various situations

Each educational institution has not only an educational program approved by the Ministry of Education, but also a curriculum, that is, a study period and a vacation period, which is basically the same for all universities. But after all, life circumstances or illnesses do not choose a convenient time for a student to be absent from the university and happen at the most inopportune moment, which raises questions about how academic leave is issued in emergency or non-standard situations.

In the first year

For example, a student may fall ill not only in the first year, but also during the first semester, may be injured or be drafted into the army, which implies the need for an academic leave.

In such a situation, this type of leave, at the request of the student, will be granted to him, because this rule is enshrined in law, however, given that the training was interrupted at the very beginning, at the end of the vacation, the student will start studying again, that is, from the beginning of the semester, and not from its middle.

During pregnancy and childbirth

Pregnancy may also come suddenly, regardless of the curriculum and passing the final exams, while the student may feel unwell and not be able to attend classes not only for several weeks, but also for months, therefore, at her request and on the basis of a certificate of special state academic leave can be obtained at any time.

But again, it should be remembered that if the semester is not closed, that is, the final tests have not been passed, at the end of the vacation you will have to start all over again, that is, from the moment the last session was passed.

Early termination

One more feature should be noted. Based on the law, every student is given the right to academic leave, but at the same time, he also the right to interrupt it ahead of schedule if the reasons for issuing a vacation have exhausted themselves or ceased to interfere with education. So in clause 7 of Order No. 455 it is said that at the request of the student and on the basis of the order, the student can be admitted to classes, but on the conditions that are determined by the Charter of the educational institution.

That is, if a student took a vacation for a year, and was released after two months, he can be restored by surrendering academic debt in a number of subjects. If the student is released after six months, he can take an accelerated course of study under the missed course program, if such a condition is enshrined in the Charter.
