Agreement on the provision of training services (public offer)
1. GENERAL PROVISIONS
1.1. By accessing this website - site - (hereinafter referred to as the Contractor), the user (hereinafter referred to as the Customer) confirms his consent to use the website in accordance with the terms of use prescribed in this agreement.
1.2. In accordance with Article 633 of the Civil Code of Ukraine, this agreement is a public offer (public agreement), and in case of acceptance of its terms (acceptance), the Customer undertakes to fulfill them in good faith.
1.3. Disagreement of the Customer with the conditions specified in this Agreement entails the impossibility of the Contractor to provide services (online training).
1.4. The Customer grants permission to the Contractor to process his personal data in accordance with the Law of Ukraine "On the Protection of Personal Data".
2. SUBJECT OF THE CONTRACT
2.1. The Contractor, in accordance with the terms of this Agreement, provides the Customer with training services in accordance with the curricula, a detailed description of which is contained on the website (hereinafter referred to as online training services).
2.2. The fact of payment by the Customer for training services indicates the unconditional acceptance by the Customer of the conditions specified in this Agreement.
2.3. The cost of training services is determined depending on the curriculum chosen by the Customer.
2.4. The Contractor reserves the right to change the cost of curricula at its discretion with prior information on the website.
3. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR
3.1. The Contractor undertakes:
3.1.1. On the basis of this Agreement and after paying the cost of the curriculum chosen by the Customer, provide him with services on time and for the period determined by the specified curriculum.
3.1.2. Prior to the start of the provision of services, provide access to instructions (text / video) that explain how to complete the training according to each of the selected curricula.
3.1.3. Ensure the continuity of the educational process in accordance with the curriculum chosen by the Customer.
3.1.4. Provide access to educational materials (video lessons) within 24 hours from the date of payment for the selected curriculum.
3.1.5. Resolve technical issues that prevent viewing of training materials within three business days.
3.1.6. Timely notify the Customer about the appearance of additional lessons in the selected (already purchased) curriculum.
3.1.7. Provide the Customer with services in accordance with the terms of this Agreement.
3.2. The performer has the right:
3.2.1. Suspend / terminate the provision of training services to the Customer (until the circumstances are clarified or permanently) unilaterally in the following cases:
- The Customer violated the terms of this Agreement;
- In case of illegal or dubious actions in the Customer's account;
- In case of unauthorized attempts to transfer/distribute course materials to third parties;
3.2.2. Unilaterally terminate this Agreement ahead of schedule in case of non-compliance by the Customer with its terms.
3.2.3. Unilaterally make changes to this Agreement, as well as curricula and the cost of training services with their preliminary publication on the website.
3.2.5 Replace video lessons if errors or technical malfunctions are found.
4. RIGHTS AND OBLIGATIONS OF THE CUSTOMER
4.1. The customer is obliged:
4.1.1. Faithfully fulfill the terms of this Agreement, comply with the rules of conduct and pay a fee for training services according to the selected curriculum.
4.1.2. Before starting the provision of training services, be briefed on the rules of training.
4.1.3. Do not transfer access to your account to third parties.
4.1.54 Do not publish, transfer to third parties or use for commercial purposes methodological materials provided to the Customer in the course of providing him with training services, including for independent work.
4.2. The customer has the right:
4.2.1. Receive the training services provided for in this Agreement.
4.2.2. Require the Contractor to comply with the terms of this Agreement.
4.2.3. Make payment to the Contractor for training services, according to the chosen curriculum, in any of the ways provided for by the current legislation of Ukraine.
4.2.4. Terminate this Agreement unilaterally, subject to prior notice to the Contractor two days in advance. In the event of early termination of this Agreement, the training service fee will not be refunded to the Customer.
5. PAYMENT PROCEDURE
5.1. The training services under this Agreement are provided solely on the terms of 100% payment of their cost for a specific curriculum.
5.2. All payments are made in the national currency of Ukraine - the hryvnia.
5.3. The Contractor is not responsible for the order of transfer/credit of funds.
5.4. The moment of payment is the moment of crediting funds to the account of the Contractor or receipt of cash by the Contractor.
6. RESPONSIBILITY
6.1. For non-fulfillment or improper fulfillment of the terms of this Agreement, the Contractor and the Customer shall be liable under this Agreement and the current legislation of Ukraine.
6.2. The Customer is aware that his violation of the terms of this Agreement leads to its termination by the Contractor unilaterally with the subsequent termination/suspension of the provision of training services.
6.3. The Contractor assumes full responsibility in accordance with the requirements of the Law of Ukraine "On the Protection of Personal Data".
6.4. The Contractor is not responsible for unedited methodological materials that are transferred to the Customer when providing him with training services according to the chosen curriculum, including for independent work.
6.5. The Customer is fully responsible for illegal access and unauthorized intervention in the operation of computers, systems and computer networks in accordance with the current legislation of Ukraine.
6.6. In case of violation by the Customer of the terms of the Agreement, the Contractor shall be released from fulfilling the obligations assumed under this Agreement.
7. FORCE MAJOR
7.1. The Contractor and the Customer are released from liability for full or partial failure to fulfill their obligations under this Agreement, if this was the result of force majeure circumstances that arose after the entry into force of this Agreement as a result of emergency events that could not be foreseen and which could not be prevented by reasonable measures. .
8. TERM OF THE CONTRACT
8.1. The Agreement comes into force from the moment the Customer pays for the training services to the Contractor and is valid for the entire period specified in the curriculum chosen by the Customer.
8.2. This Agreement may be terminated (terminated) with the consent of the Customer and the Contractor.
8.3. In the event that the Customer decides to terminate (terminate) this Agreement after the start of the provision of training services, while the Customer has made full payment for training services, the Contractor shall not return the funds to the Customer.
9. DISPUTES RESOLUTION
9.1. All disputes and disagreements that have arisen regarding the fulfillment of the terms of this Agreement shall be resolved through negotiations on the basis of a written application (claim) of the Customer, with the addition of a check (receipt) for payment for training services.
9.2. The Contractor, after receiving an application (claim) from the Customer, is obliged within 20 (twenty) days to satisfy the stated requirements or send a reasoned refusal to the Customer.
9.3. If the dispute that has arisen is not settled in the complaint procedure, the Customer or the Contractor has the right to apply to the court at the location of the Contractor.
9.4. The customer of the services guarantees that all the terms of this Agreement are clear to him, and he accepts them unconditionally and in full.
