According to the organization that acted as an advertiser and was brought to administrative responsibility, the message about free vision testing on the latest equipment is aimed at advertising the opening of an optics salon. In the opinion of the complainant, vision testing does not apply to medical services.

The backstory is this. The company distributed advertisements for the services of the "VIDI optics" optics salon, informing consumers about the opening of an optics salon, the possibility of acquiring glasses from world brands, as well as providing services for free vision testing using the latest equipment.

By the decision of the OFAS in the Republic of Buryatia, the advertising of goods and services for free vision testing of the optics salon "VIDI optics" distributed by the society was recognized as inappropriate and inconsistent with paragraph 7 of Art. 7 Federal Law N 38-FZ<5>due to the advertiser's lack of a license to carry out medical activities.

  • it cannot be concluded from the content of the video that the purpose of free testing on the latest equipment in the optics salon is to determine the parameters of visual acuity in diopters for the subsequent prescription of corrective glasses, it does not contain a message about the involvement of an ophthalmologist when testing vision, does not indicate the testing mechanism;
  • OFAS in the Republic of Buryatia did not provide evidence that when testing vision by an individual entrepreneur Dambinov D.A. carried out exclusively medical activities;
  • the message about the provision of services for free vision testing on the latest equipment is not an object of advertising. As can be seen from the ad placed, it contains information not only about the salon "VIDI optics", but also about the provision of services for free vision testing on the latest equipment. According to society, a free service is not an entrepreneurial activity, is not a product and cannot act as an object of advertising. Goods - a product of activity (including work, service) intended for sale, exchange or other introduction into circulation (Article 3 of Federal Law N 38-FZ). The medical service is intended to be put into circulation, and therefore is the object of advertising, regardless of the form of payment.

However, these arguments, according to the judges, cannot be taken into account.

In refusing to satisfy the company's application to declare the decision invalid, the courts of two instances proceeded from the fact that the contested non-normative legal act complies with Federal Law N 38-FZ and does not violate the rights and legitimate interests of the company. The courts considered that testing in the VIDI Optics salon for the purpose of diagnosing vision and selecting glasses on equipment relates to medical activities in the field of medical optics and ophthalmology, and therefore the provision of these services can only be carried out on the basis of a license.

In accordance with Art. 3 of the Federal Law N 38-FZ advertising - information disseminated in any way, in any form and using any means, addressed to an indefinite circle of persons and aimed at drawing attention to the object of advertising, generating or maintaining interest in it and promoting it on the market; improper advertising - advertising that does not comply with the requirements of the legislation of the Russian Federation.

According to paragraph 7 of Art. 7 of Federal Law N 38-FZ, it is not allowed to advertise goods, the production and (or) sale of which requires obtaining licenses or other special permits, in the absence of such permits.

From paragraph 7 of Art. 38 of the Federal Law N 38-FZ it follows that the advertising distributor is liable for violation of the requirements established by Art. 7 of this Law.

In accordance with paragraph 1 of Art. 17 of the Federal Law of 08.08.2001 N 128-FZ "On Licensing Certain Types of Activities"<6>medical activity is subject to licensing.

Decree of the Government of the Russian Federation of January 22, 2007 N 30<7>approved the Regulations on the licensing of medical activities. By virtue of clause 4, medical activity provides for the performance of work (services) for the provision of pre-medical, outpatient, inpatient, high-tech, emergency and spa medical care in accordance with the List in accordance with the Appendix. According to the Letter of Roszdravnadzor dated February 15, 2005 N 02I-52/05 "On the procedure for licensing work related to the manufacture of corrective glasses" when spectacle optics manufacturers carry out activities for examining a patient by an ophthalmologist, selecting glasses, etc. a medical license is required.

As follows from the materials of the case, the company, on the basis of a contract for advertising services, provided the owner of the optics salon "VIDI optics", an individual entrepreneur Dambinov D.A., services for the production and placement of advertising products (rental) on a television channel.

The company placed on the TV channel the following information: "Look at life in a new way. Free vision testing on the latest equipment for each buyer."

The judges of two instances, taking into account the content of the video and the above rules of law, came to the correct conclusion that the company, being an advertising distributor, distributed an advertisement for medical activities. At the same time, as established by the judges, the individual entrepreneur Dambinov D.A. during the period of distribution of advertising there was no license to carry out medical activities.

Production of spectacle optics: which taxation regime to choose?

To answer this question, first of all, it should be determined whether the manufacture of spectacle optics falls under the taxation regime in the form of UTII, since its application is mandatory. Otherwise, the taxpayer has the right to choose between the general taxation regime and the simplified taxation system.

In accordance with paragraph 2 of Art. 346.26 of the Tax Code of the Russian Federation, the taxation system in the form of UTII for certain types of activities can be applied by decision of the representative bodies of municipal districts, urban districts, legislative (representative) government bodies of federal cities of Moscow and St. Petersburg, including in relation to the provision of personal services, their groups, subgroups, types and (or) individual household services classified in accordance with the All-Russian classifier of services to the population OK 002-93<8>(OKUN).

  • consumers of this pharmacy service are individuals who purchase goods for their personal needs;
  • provision of services for the production of spectacle optics is carried out on the basis of a household contract. According to paragraph 1 of Art. 730 of the Civil Code of the Russian Federation, under a household contract, the contractor carrying out the relevant entrepreneurial activity undertakes to perform, on the instructions of a citizen (customer), certain work designed to satisfy the household or other personal needs of the customer, and the customer - to accept and pay for the work.

By virtue of Art. 346.27 of the Tax Code of the Russian Federation, household services include paid services provided to individuals (with the exception of pawnshop services and services for the repair, maintenance and washing of motor vehicles) provided for by OKUN, with the exception of services for the manufacture of furniture, construction of individual houses.

Officials of the main financial department, in their explanations, adhere to the position according to which only those organizations and individual entrepreneurs that provide paid household services to individuals (the population) on the basis of household contracts are recognized as UTII payers in terms of the provision of personal services.
